WiBI Network Terms and Conditions

 

I. Definitions

  1. WiBI Network – network access points, shared or managed by Intelligent Technologies S.A., with the registered office at Sękocin Nowy, Al. Krakowska 61A, 05-090 Sękocin Nowy, KRS: 0000187832, NIP: 108-00-00-059 (hereinafter referred to as “Operator“), to which access is possible after accepting of this document or expressing appropriate consents, WiBI Network allows you to wirelessly connect to the Internet through its network. Access to the Internet is a service independent of the WiBI Network and can be provided by an internet service provider other than Operator.
  2. User – a person using WiBI Network via a Terminal.
  3. Internet Service Provider – an entity that provides Internet network through Wi-Fi Network.
  4. Terminal – user device, connected to a WiBI Network (notebook, computer, mobile phone, etc.).
  5. Reach Zone – a place where you can connect Terminal with the Network WiBI.
  6. Partner – entity for which the Operator provides the WiBI Network services.

 

II. WiBI Services

  1. WiBI Network services is a service that allows access to WiBI Network. Access is possible only when the terminal is in Reach Zone and meets the technical requirements of WiBI Network.
  2. The use of WiBI Network constitutes acceptance of the conditions set in the Terms of Service and can be done only on the basis specified in the WiBI Network Terms and Conditions.
  3. Violations of WiBI Network User Terms of use can result in prevent access to WiBI Network.

 

III. WiBI Network User Terms of use

  1. The pre-condition of using WiBI Network, in particular, to log on to the network is acceptance of WiBI Network Terms and conditions
  2. login to the WiBI network may depend also on:
    1. filling in the questionnaire,
    2. registration,
    3. log in via social networking,
    4. provide an email address,
    5. display advertising, promotional another media with which you must read,
    6. consent to the processing of personal data
    7. consent to the transfer of commercial information by e-mail.
  3. Technical conditions in the WiBI Network devices (non-Operator devices) including emitting a radio signal delay in the Internet can affect real transfer to and from Terminal, for which Operator shall not be liable.
  4. due to the technology involved to use of WiBI Network can be associated with:
    1. violation of third party data gathered or transmitted by User
    2. delay in receiving or transmitting data, due to lack of transmission capacity, incorrect transmission, delays or interruptions in access to WiBI Network,
    3. other violations of Terminal software.
  5. Operator informs that in connection with the technical requirements resulting the underlying technology (radio signal) there can be no continuous signal coverage Range of Reach Zone.
  6. Operator indicates that the availability of applications and baud rate depends in particular on the number of people using the WiBI Network resources.

 

IV. Limitations

  1. Access to WiBI Network may be limited spatially, temporally, and in terms of technical parameters of the connection.
  2. Operator reserves the right to:
    1. to impose restrictions on the duration of the call, bit rate, limit the transmitted data and different transmission parameters,
    2. limiting and blocking access to certain content and services on the Internet,
    3. record and monitor the information or data to ensure safety or WiBI Network management.

 

V. Liability of the User

  1. User can use WiBI Network, provided acknowledgement and acceptance of WiBI Network Terms and Conditions.
  2. The User is not allowed to use WiBI Network to pursue any activities which violate the current law, in particular:
    1. to render available and download from the Internet: materials protected by copyrights (software, films, music, etc.), pornographic, racist, Nazi content, etc.,
    2. distribute and render available any content which might violate anyone’s personal rights,
    3. distribute advertising materials not ordered by the recipients (so-called spam),
    4. spread computer viruses and other applications which may damage the software or data of other internet users,
    5. gain unauthorized access to IT resources being in possession of other Internet users,
    6. breach the security measures protecting the WiBI Network.
  3. The User is not allowed to use the WiBI Network:
    1. to launch service servers on the Terminal,
    2. for commercial purposes without the Operator’s knowledge and written consent,
    3. to undertake any other activities which may be considered to be dangerous to the operation of the WiBI Network or contrary to applicable law.
    4. to render the connection to the internet available to other entities through teletechnical devices such as Access Point, router, etc.
  4. Should the User not abide by the provisions of these Regulations and should he use the WiBI Network inconsistently with its purpose, Operator has the right to block temporarily or permanently the Terminal’s access to the network.

 

 VI. Processing of personal data

  1. The administrator of personal data, only to provides the WiBI Network, is Operator.
  2. The administrator of personal data, which are different from personal data referred above in (a), is Partner.
  3. Personal Data  will be processed pursuant to the Regulation of the European Parliament and the Council (UE) 2016/679 dated April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (Data Protection Directive), the so-called “RODO”.
  4. Operator have appointed a Data Protection Officer. You can contact this person in all matters that involve processing of personal data by contact form on the website www.itsa.pl, by the following e-mail address odo@itsa.pl or in writing at Intelligent Technologies S.A. registered office address.
  5. Collection data are processed in order to provide with WiBI Network. Data may be processed for transmission of the commercial information also originating from other entities after complying with the necessary requirements arising from generally applicable law.
  6. Operator ensure that your rights are exercised in accordance with generally applicable law including the right to access your personal data, the right to rectification and deletion of the data, the right to limitation of processing, the right to object against processing, the right to portability of the data, and the right to lodge a complaint with the supervisory authority.
  7. Operator has no intention to transfer collected data to neither third country nor international organizations
